Terms of Use

These Terms of Use govern access to and use of CAPS by CapsulePros. CAPS is proprietary control-plane software operated by Lee Evans. By accessing, creating a workspace within, or otherwise using CAPS, you agree to be bound by these terms.
1. Service Description
CAPS provides control-plane software for tenant-scoped access management, wallet-funded billing, API key issuance, policy enforcement, service routing, usage accounting, receipts, auditability, and related operational functions for paid API and service execution.
2. Eligibility and Authority
You may use CAPS only if you have the legal capacity and authority to do so on your own behalf or on behalf of the business or organisation you represent. If you create or operate a tenant on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
3. Acceptable Use
You must not misuse CAPS, attempt unauthorised access, interfere with platform integrity, reverse engineer restricted components, circumvent security controls, or use CAPS for unlawful, abusive, fraudulent, harmful, or infringing activity.
4. Accounts, Credentials, and Security
You are responsible for all activity occurring under your operator credentials, API keys, billing access, and workspace controls. You must maintain the confidentiality of credentials, apply reasonable internal access controls, and notify CapsulePros promptly if you suspect compromise, misuse, or unauthorised access.
5. Billing and Wallet Funding
Wallet funding, top-ups, and related payment actions may be processed through CAPS and connected payment providers including Stripe. Prepaid wallet balances may be consumed by authorised usage, charges, fees, and service execution in accordance with the policies and permissions configured for your tenant.
6. Availability and Changes
CAPS is provided on a commercially reasonable basis. We may update, modify, suspend, restrict, or discontinue part of the service where necessary for maintenance, improvement, operational stability, legal compliance, or security.
7. Intellectual Property
All rights, title, and interest in CAPS, including software, workflows, branding, interface design, control logic, documentation, and related materials, remain vested in Lee Evans and CapsulePros unless expressly agreed otherwise in writing.
8. Data and Records
Operational, billing, security, and audit records generated through CAPS may be retained and used as reasonably necessary to provide the service, protect the platform, investigate misuse, support accounting, respond to disputes, and comply with applicable legal obligations.
9. Warranties and Liability
To the fullest extent permitted by law, CAPS is provided on an “as is” and “as available” basis without guarantees of uninterrupted or error-free availability. Nothing in these terms excludes liability where such exclusion is unlawful. Subject to that, liability is limited to the amount paid for the service during the relevant period giving rise to the claim.
10. Governing Basis
These terms are intended to be interpreted and enforced in a commercially reasonable manner consistent with applicable law in the United Kingdom, unless otherwise agreed in writing.
